Welcome to OtherSIM. These Terms of Service ("Terms") govern your use of our virtual phone number service. By using OtherSIM, you agree to these Terms.

1. Acceptance of Terms

By accessing or using OtherSIM, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use our service.

2. Service Description

OtherSIM provides:

  • Virtual phone numbers for SMS verification
  • Temporary and rental phone numbers
  • SMS and call services
  • eSIM data plans

Our service is provided "as is" and availability may vary by region and service. OtherSIM operates solely as a technical intermediary, providing virtual phone numbers and message delivery services. We do not control or monitor the content of messages received through our service.

3. Account Registration

Requirements

  • You must be at least 18 years old
  • Provide accurate and complete information
  • Maintain the security of your account credentials
  • Notify us immediately of unauthorized access

Account Responsibility

You are responsible for all activities under your account, including any actions taken by third parties with access to your credentials. You agree to use the service in compliance with all applicable laws and the terms of service of any third-party platforms.

4. Acceptable Use

Permitted Uses

  • SMS verification for legitimate personal accounts
  • Privacy protection for personal use
  • Business verification needs for permitted services
  • Testing and development purposes

Prohibited Uses

You may NOT use OtherSIM for:

  • Illegal Activities: Any activity that violates local, state, national, or international law, including but not limited to money laundering, terrorism financing, or human trafficking
  • Financial Services: Banking applications, financial institutions, payment processors, cryptocurrency exchanges, digital wallets, or any financial services that require identity verification for regulatory compliance (KYC/AML)
  • Government Services: Government portals, tax services, or official identity verification systems
  • Healthcare Services: Medical platforms, health insurance, or healthcare providers requiring identity verification
  • Fraud and Identity Theft: Activities that facilitate identity theft, account takeover, unauthorized access to accounts, or creating accounts with false information
  • Impersonation: Misrepresenting your identity or impersonating another person or entity
  • Harassment: Threatening, stalking, or harassing others
  • Spam: Sending unsolicited bulk messages or calls
  • Mass Registration: Automated mass account creation or systematic abuse of verification services
  • Terms Violations: Using our numbers on platforms where temporary or virtual numbers explicitly violate their terms of service
  • Resale: Reselling our services without authorization
  • Interference: Disrupting our service, circumventing security measures, or attempting denial-of-service attacks
  • Malware: Distributing malware, viruses, or other harmful software
  • Illegal Content: Distributing illegal, harmful, or exploitative content

Important Notice: OtherSIM is not responsible for monitoring or controlling how customers use the provided services. However, we reserve the right to suspend or terminate accounts immediately, with or without prior notice, for suspected abuse, violation of these terms, or upon request from law enforcement.

5. Credits and Payments

Credit System

  • Services are paid for using credits
  • Credits must be purchased before use
  • Credit prices may change with notice

Purchases

  • All purchases are final
  • Credits do not expire while your account is active
  • Refunds for unused credits may be available upon request

Pricing

  • Prices are displayed before purchase
  • We may change prices with reasonable notice
  • Promotional pricing may have limitations

6. Service Availability

Uptime

  • We strive for high availability but do not guarantee 100% uptime
  • Scheduled maintenance will be announced when possible
  • We are not liable for service interruptions

Number Availability

  • Phone number availability varies by country and service
  • Numbers may be released after rental expiration
  • We do not guarantee specific numbers will be available
  • Numbers are assigned dynamically and may have been used by previous customers

Service Limitations

  • We cannot guarantee SMS delivery timing or success rate
  • Some platforms may block or restrict virtual phone numbers
  • Emergency services (911, 112, etc.) are NOT available through our virtual numbers
  • We do not guarantee continuous availability of specific country codes or number types

7. Verification Success

No Guarantees

  • We provide phone numbers and message delivery
  • We cannot guarantee verification success on third-party platforms
  • Success depends on external platform policies which are outside our control
  • Third-party platforms may change their policies at any time

Refund Policy

  • Credits are refunded if messages are not delivered due to our technical issues
  • No refunds for verification failures due to platform restrictions or blocks
  • No refunds for numbers blocked by third-party platforms
  • Support tickets must be submitted within 24 hours

Force Majeure

We are not liable for delays or failures due to circumstances beyond our reasonable control, including but not limited to telecommunications provider failures, natural disasters, government actions, or other force majeure events.

8. Intellectual Property

Our Property

  • OtherSIM name, logo, and branding are our property
  • Service software and technology are proprietary
  • You may not copy, modify, or distribute our materials

Your Content

  • You retain rights to your content
  • You grant us license to process your data for service delivery
  • We may use anonymized data for analytics

9. Privacy

Your use of OtherSIM is subject to our Privacy Policy. By using our service, you consent to our data practices as described therein.

10. Third-Party Services

  • We integrate with third-party payment processors
  • We are not responsible for third-party service issues
  • Third-party terms may apply to certain features

11. Limitation of Liability

Disclaimer

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • We provide the service "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied
  • We do not guarantee uninterrupted or error-free service
  • We make no warranty that the service will meet your requirements
  • We do not warrant the accuracy, reliability, or completeness of any information

Exclusion of Damages

WE SHALL NOT BE LIABLE FOR ANY:

  • Indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, data, use, goodwill, or other intangible losses
  • Damages resulting from unauthorized access to or alteration of your data
  • Damages resulting from any third-party conduct or content
  • Damages arising from your use of or inability to use the service

Liability Cap

Our total aggregate liability shall not exceed the lesser of: (a) the amount you paid us in the 12 months preceding the claim, or (b) $100 USD.

Basis of the Bargain

You acknowledge that the limitations set forth in this section are fundamental elements of the agreement between you and OtherSIM, and that OtherSIM would not provide the service to you absent such limitations.

12. Indemnification

You agree to defend, indemnify, and hold harmless OtherSIM, its affiliates, officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from:

  • Your violation of these Terms
  • Your use or misuse of the service
  • Your violation of any third-party rights or terms of service
  • Your violation of any applicable laws or regulations
  • Any fraudulent, abusive, or illegal activity conducted through your account
  • Any content or data you submit or receive through the service

13. Modifications to Service

We may:

  • Modify or discontinue features
  • Change pricing with notice
  • Update these Terms

Continued use after changes constitutes acceptance.

14. Termination

By You

  • You may close your account at any time
  • Remaining credits may be refundable per our policy

By Us

We may suspend or terminate your account for:

  • Violation of these Terms
  • Fraudulent activity
  • Extended inactivity
  • Legal requirements

15. Dispute Resolution

Governing Law

These Terms are governed by the laws of the jurisdiction where OtherSIM is incorporated.

Informal Resolution

Before filing a claim, contact us to attempt informal resolution.

Arbitration

Disputes shall be resolved through binding arbitration, except where prohibited by law.

16. General Provisions

Entire Agreement

These Terms constitute the entire agreement between you and OtherSIM.

Severability

If any provision is found unenforceable, other provisions remain in effect.

Waiver

Failure to enforce a right does not waive that right.

Assignment

You may not assign your rights. We may assign our rights freely.

  • Data protection and privacy laws
  • Telecommunications regulations

19. No Waiver

Our failure to enforce any provision of these Terms shall not be deemed a waiver of such provision or the right to enforce such provision.

We will notify users of material changes via email or service notification. Your continued use of the service after such changes constitutes acceptance of the new Terms. Review Terms periodically for updates.
